Terms of Use
These terms set out the rules for accessing and using the chateaudemontcornet.fr website, together with the undertakings of the association LES AMIS DE MONTCORNET and those of its visitors.
01
Purpose
The purpose of these terms of use (hereinafter the “Terms”) is to set out how the chateaudemontcornet.fr website (hereinafter the “website”) is made available, and the conditions under which any person accessing it (hereinafter the “user”) may consult it and use its features.
The website is published by the association LES AMIS DE MONTCORNET, a non-profit association under the French Act of 1901 whose registered office is at 11 Terre Cadet, 08090 Montcornet. Information about the publisher, the publication director and the hosting provider appears in the **legal notice**, which forms an integral part of these Terms.
The purpose of the website is to provide information and to promote heritage. It is neither a booking platform nor an online shop.
This information is published pursuant to Article 6 III of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy, which requires any publisher of an online public communication service to make its identity and contact details available to the public.
02
Acceptance of the terms
Consulting the website constitutes full and unreserved acceptance of these Terms. Users who do not accept them are asked not to use the website.
Certain features, such as leaving a message in the guestbook or sending a message through the contact form, additionally require express acceptance, given by ticking a box or by submitting the form.
The Terms can be consulted at any time from the footer of the website. Users are advised to read them on each visit, the applicable version being the one online at the time of use.
03
Access to the website
Free and open access
Access to the website is free and unrestricted. The connection, equipment and subscription costs required to consult it remain payable by the user.
No account required
Consulting the website requires neither registration nor the creation of an account. Administration accounts are reserved for authorised members of the association and for the technical providers it appoints.
Availability and maintenance
The association endeavours to provide continuous access to the website, without guaranteeing any particular outcome. It may at any time, without notice or compensation, temporarily interrupt access for reasons of maintenance, updating, technical development or security, or change the content and features of the website.
Technical compatibility
The website is designed to be viewed on computers, tablets and phones, using a recent browser with JavaScript enabled. Display problems may occur with older browsers or unusual configurations.

05
User undertakings
Users undertake to use the website in accordance with its intended purpose, with these Terms and with the laws and regulations in force, and not to infringe the rights of third parties or the reputation of the association and of the monument.
The following are prohibited in particular:
– any attempt to gain unauthorised access to the website, to its administration area, to its servers or to its database;
– any action intended to disrupt, slow down or alter the operation of the website, in particular the introduction of malicious programs;
– the systematic and automated extraction or reuse of all or part of the content, in particular by scraping, harvesting or large-scale collection, without the written permission of the association;
– the collection of contact details published on the website for the purposes of canvassing or unsolicited messages;
– impersonating a third party or falsely claiming to be a member of the association;
– publishing content that is unlawful, insulting, defamatory, hateful, discriminatory, violent or pornographic, or that infringes privacy or image rights;
– any use of the website for commercial, advertising or prospecting purposes.
Users are solely responsible for the use they make of the website, for the information they publish on it and for the consequences that follow.
06
Guestbook
The guestbook allows visitors to the castle to leave a testimonial, which will be published on the website after checking.
Publication rules
- messages relate to the castle, the visit, the events or the life of the association;
- the name or pseudonym and the town, where given, are published; the email address requested is never published and is used solely to contact the author if necessary;
- the message contains no personal contact details of third parties, no remarks contrary to the law or to public decency, no advertising or promotional content, and no link to a third-party site unrelated to the castle;
- the author certifies that they are the author of the text published and that they hold the necessary rights in the material they include in it.
Moderation
Messages are moderated before publication. The association reserves the right, without having to give reasons and without notice, to refuse, postpone, alter the presentation of, or delete any message that does not comply with the rules above, or whose publication would be liable to harm a third party or the association. A refusal to publish does not give rise to any compensation.
Rights in published messages
By publishing a message, the author authorises the association to reproduce and distribute it free of charge on the website, in its communication materials and at its events, for as long as the message is published and for the sole purpose of promoting the castle and the work of the association. The author retains ownership of their text and may request its removal at any time by writing to info@chateaudemontcornet.fr.
Liability
Published messages express the views of their authors and are their responsibility alone. The association, which acts in this respect as a host within the meaning of Article 6 I 2 of French Act no. 2004-575 of 21 June 2004, promptly removes any manifestly unlawful content reported to it in accordance with the procedure set out in the legal notice.
07
Contact form
The contact form can be used to send a request for information, a request for a group or school visit, or a project proposal. The fields requested are the name, the email address and the message.
Users undertake to provide accurate information and not to use the form to send unsolicited, advertising or automated messages. The association, run by volunteers, endeavours to reply as promptly as possible, without being able to guarantee a response time. Sending a message constitutes neither a booking nor confirmation of a visit.
The data submitted through the form is processed under the conditions described in the legal notice.
08
Donations and support for the association
The website collects no payments. Visitors who wish to support the association are redirected to the online platform it uses to receive donations and memberships.
Transactions carried out on that platform are governed by the terms and conditions and privacy policy of its operator, which donors should consult. The association has access only to the information that the platform passes on to it in connection with the monitoring of donations.
Anyone wishing to support the association in other ways — volunteering, donations in kind, corporate patronage, loan of equipment — may contact the association directly.
09
Visitor information and conditions of admission
The opening hours, admission prices, dates and visiting arrangements published on the website are given for guidance only and may be changed at any time, in particular in the event of bad weather, restoration work, safety requirements, private hire of the site or an unforeseen event. We recommend confirming this information before travelling.
Visits take place in a partly ruined historic monument: uneven ground, old staircases, underground passages and narrow openings. Visitors must comply with the safety instructions displayed on site and with the instructions given by the volunteers. Children remain at all times under the responsibility of the adults accompanying them; school groups remain under the responsibility of their supervisors.
The conditions of admission applicable on site — accessibility, animals, photography, conduct — are those displayed at the entrance to the monument and communicated by the association. They prevail over any information published on the website.
10
Intellectual property
The content of the website is protected by copyright and related rights. Users are granted a strictly personal and private right of use: they may consult the pages, print them and keep a copy for their own use, to the exclusion of any distribution, publication or exploitation, in particular commercial exploitation.
Any other use, in particular the reproduction of texts or photographs on another website, a professional social network, a brochure or an advertising medium, requires the prior written permission of the association. The applicable rules are set out in detail in section 6 of the legal notice.
Sharing a link to a page of the website, without reproducing its content, remains permitted under the conditions set out in the legal notice.
11
Personal data
The processing of personal data carried out in connection with the use of the website — contact form, guestbook, technical logs — is described in detail, together with the purposes, legal bases and retention periods, in section 9 of the legal notice.
Users will also find there how to exercise their rights of access, rectification, erasure, restriction, objection and portability, as well as information about the cookies used by the website.
12
Third-party links and content
The website contains links to third-party sites and embeds a map provided by an external mapping service. The association exercises no control over these resources and accepts no liability as to their content, their availability or the data processing they carry out.
The conditions under which a link may point to the website are set out in section 7 of the legal notice.
13
Liability
The association does everything it can to provide accurate and up-to-date information. It does not, however, guarantee that the information published is complete, free of error or permanent, and it cannot be held liable for:
– errors, inaccuracies or omissions in the information published, in particular opening hours, admission prices and event dates;
– any interruption, slowdown or unavailability of the website, whatever the cause;
– any direct or indirect damage resulting from access to the website or from its use, including loss of data or damage to the user’s equipment;
– the content of third-party sites reachable through links;
– messages published by users in the guestbook;
– any use of the website that does not comply with these Terms.
The association cannot be held liable in the event of force majeure within the meaning of Article 1218 of the French Civil Code, nor for the acts of a third party or of the user themselves.
14
Breaches
In the event of a breach of these Terms, the association may, without notice or compensation, delete the content concerned, block access to the website from the address from which the breach originated, and take any appropriate action, including legal proceedings, in compensation for the harm suffered.
Acts liable to constitute a criminal offence may be reported to the competent authorities.
15
Amendments to the terms
The association may amend these Terms at any time, in particular to take account of legal or technical developments or changes to the services offered. The applicable terms are those online on the day the website is consulted; the date of their latest update appears at the top of the page. It is for users to consult them regularly.
16
Governing law and jurisdiction
These Terms are governed by French law and are drafted in French.
In the event of difficulty, users are invited to contact the association in order to seek an amicable solution. Failing agreement, any dispute relating to the validity, interpretation or performance of these Terms shall be brought before the competent French courts.
*If the association is regarded as a trader within the meaning of the French Consumer Code on account of its paid public admission activity, add here the contact details of the consumer mediator to which it is subject (Article L. 612-1 of the Consumer Code) and the link to the European online dispute resolution platform. To be checked with the association.*
